Blood Alcohol Concentration (BAC) – What you Need to Know

Blood Alcohol Concentration (BAC) is a measurement of the concentration of alcohol in a person’s blood. In the state of Virginia it is illegal for you to operate a motor vehicle if your BAC is 0.08% or higher. Having a BAC of 0.08% means there are 0.08 grams of alcohol present per 100 milliliters of blood.

The number of drinks consumed is a poor measure of your BAC, largely because of variations in weight, sex, and body fat. There is a generally accepted belief that the consumption of one standard drink of alcohol will increase the average person’s BAC roughly 0.02% to 0.05% and take approximately 1.5 to 3 hours to reduce back to 0.0% if no other drinks are consumed.

When you are stopped for driving under the influence, you will be asked to submit to a breath alcohol test by the police officer. You have the right to refuse to take to the portable preliminary breath alcohol test in the field, but it is a violation of law to refuse to take the breath alcohol test administered at the station.

BAC, especially those preformed through breathalyzers, are not always 100% accurate. Inaccuracy can stem from many things, including: defective test equipment, improper test administration, unlicensed or uncertified person administering the test, and police radio interference (common with breath alcohol tests). Additionally, you may have an inaccurate BAC if you ate before the test, used mouthwash, hiccupped, vomited, or even wore dentures.
